New FL MMJ Rule: What Patients and Caregivers Need to Know

The Florida Department of Health’s Office of Medical Marijuana Use (OMMU) recently issued an important update regarding the Medical Marijuana Use Registry (MMUR) identification card application process.

Pursuant to Department of Health Rule 64-4.011(b), the state is implementing a new procedural requirement designed to streamline registry eligibility. Here is a breakdown of what this change means for our MMTCFL community and how you can ensure your access to treatment remains uninterrupted.

What is the New Rule?

Starting July 27, 2026, the OMMU will require active medical certifications or connections to be established before an individual can submit a card application.

For Patients: You may only complete a Medical Marijuana Use Registry (MMUR) identification card application (for both initial cards and annual renewals) if you have a current or scheduled certification with active orders entered into the registry system.
For Caregivers: You may only complete your MMUR identification card application (initial or renewal) if you are directly connected to a valid and active patient within the registry.

Why This Change Matters for Florida Medical Marijuana Patients

Previously, patients could sometimes submit their annual Florida medical marijuana card applications or renewals to the OMMU even if their doctor-issued orders had lapsed, catching up on their clinical appointments later.

Under the new system, the OMMU will block applications if your doctor’s orders are not currently active or scheduled. If your state card is expiring soon, you cannot proactively renew it with the state unless your medical evaluation and certifications are up to date with your physician first.

How to Prepare: Steps for MMTCFL Patients

To prevent any delays in renewing your state ID card or purchasing your medication, we recommend taking the following steps:

Check Your Order Expiration Dates: Log into your MMUR account or contact our clinic to see when your current doctor’s orders expire. Remember, doctor certifications last a maximum of 210 days, while state ID cards must be renewed every year.
Book Your Appointments Early: If your annual state card renewal is approaching, make sure you have an active or scheduled certification appointment with your MMTCFL physician first. Do not wait until your card has completely expired to schedule your clinical evaluation.
Caregivers, Coordinate with Your Patients: If you act as a caregiver, verify that the patient you assist has active status in the registry before you attempt to submit your caregiver card renewal application.
